Rules & Regulations For New Members

Residential Eligibility
Only Residents of Wythe, Bland, Carroll, Grayson, Pulaski, and Smyth counties are eligible to sell products at the market.   We take "locally produced" very seriously and do not tolerate items that are grown elsewhere and brought in for sale or resale. Each market vendor will need to fill out a Grower Certification Form and have it signed by a County Extension Agent before being allowed to sell at the market.

Grower Certification Form:
This form is found within the Vendors Packet - all you will do is check off the produce or products that you plan to offer at the market. Then call your local Virginia Cooperative Extension Agent (276-223-6040) and ask them to stop by for a very short visit to verify that your products are locally produced in Wythe or adjoining counties.

NOTE: If you are a returning vendor and we have a form on file for you, you do not need to provide this form again in 2011.


Vendor Space and Fees
Vendor spaces in the Farmers Market will be on a first come first serve basis.  Last year’s vendors will have first right of refusal for the space they occupied in 2010.

- A one time fee of $50.00 will reserve the same location throughout the year. 
- Covered vendor spaces are $5.00 per week. 
- Uncovered vendor spaces are no charge.  
- All tables provided by the Farmer’s Market must remain in designated locations.

Equipment: Vendors are responsible for their own tables, chairs, shade devices, change, bags, etc.

Operation of stands:
- Vendors will strive to sell products of highest freshness and quality
- Vendors will be expected to conduct business in a courteous manner
- Vendors and customers are not permitted to bring pets to the market
- Products must be clearly priced and the prices displayed
- Vendors must be set up to sell by opening of market at 9:00 a.m.
- Vendor areas must be cleaned up and market area cleared by 30
   minutes after closing


Clean Up:
Each vendor will be responsible for keeping their area clean and pick up during and after the market. Vendor is responsible for removing trash from the market site. The Market Manager will secure that area is clean before closing for the day.



Selling At The Market
No items offered for sale may be jobbed: All products must be agriculturally derived and the original work of the vendor. No item offered for sale shall be commercially made, created, or produced without value added by the vendor.

Packaging:
Produce sold by piece or quantity may be sold in clean paper or plastic bags. 


Baked Goods:
Vendors are responsible for following food preparation, processing and labeling regulations required by the Virginia Department of Agriculture and Consumer Services. If you have questions about the regulations or would like more information, please see the Market Manager who can provide you with additional resources and contacts. 

- All items containing dairy products must contain pasteurized or aged products.
- All prepared food must be prepared in a VDACS-inspected and certified facility OR qualify for an exemption (see the VDACS food safety handout on the Vendor Resources page of this website).
- Prepared or processed foods including baked goods must be labeled with ingredients in descending order, weight or quantity of item being sold, and preparer’s name and location (see the VDACS food safety handout on the Vendor Resources page of this website).
- Perishable produce and food items must be maintained at appropriate temperatures with heating and cooling devices. Eggs must be kept in a cooler at 45 degrees. It is the vendor’s responsibility to supply whatever is needed to accomplish this. Vendors are required to keep a thermometer in the cooler to certify that the temperature 45 or less. An empty egg carton may be kept on view so customers know you have eggs for sale. Mark through brand names or grades used on egg cartons. 

Scale Requirements:
Scales in commercial service used for the purpose of determining weight of commodities or things sold, offered, or exposed for sale are required to be tested and inspected for applicable accuracy/specification requirements. Commercial or “Legal for Trade” quality scales are the units used by individuals, farmers, hucksters, etc. selling from their residence, farmers market, or business establishment. To be in compliance with Virginia Weights and Measures Law, contact Virginia Department of Agriculture and Consumer Services Wytheville regional office at (276) 228-5501. This is a free governmental service. 


Note:
Products sold by the piece or pre-packaged and priced by that package, not by weight, do not require scales for measurement.


Sales Tax:
Vendors are responsible for their own collection, reporting, and paying sales tax to the Commonwealth of Virginia. The tax rate is 4.5% for items not for home food consumption.  It is 2.5% for items sold for home consumption.  Forms have been included in your packet and also are available at the Commissioner of Revenue’s office located at the Wythe County Courthouse on South 4th Street in Wytheville or call (276) 223-6015.  If you need help with registration or reports, you may call your local Virginia Cooperative Extension Wythe County Agent at 276-223-6040.



Indemnification:
The vendor agrees to indemnify and hold harmless Project for Healthy Living and the landowner from any and all causes of action that may rise from the operation of this farmers market, not caused by negligence of the Wytheville Farmers Market. The Farmers Market will not discriminate against any applicant for vendor space because of race, color, religion, sex, national origin, age or marital status.



Adherence To Market Rules & Regulations:
Disputes or questions such as the provenance of items for sale, space assignment, general conduct, enforcement of market rules will be resolved by the Market Manager, Project for Healthy Living and/or the Farmer’s Market Focus Group. Violations of the rules, regulations, or provisions of the Farmer’s Market may result in the suspension or disqualification from the market.
